Sell property in Poland without stress or unnecessary hassle. MOKKO Real Estate helps you sell an apartment, house or serviced apartment in Warsaw, Kraków and Wrocław quickly and safely.
We take care of the entire process: from expert valuation and marketing to a full legal review and signing the agreement at the notary.
How do I value my apartment correctly before selling?
Rely on actual prices from closed transactions in the registers, not the asking prices on Otodom or OLX (they are inflated by 5–10%). Assess the location, the condition of the building and the outlook for the area. If you want precise analytics with a detailed breakdown of competitors, we prepare a market analysis free of charge.
How much tax do I pay when selling a home?
If you have owned the property for more than 5 years (from the end of the calendar year of purchase), PIT is 0%. If less, 19% tax is paid on the net gain. Correctly accounting for renovation and purchase costs, or using the ulga mieszkaniowa relief, helps you avoid unnecessary costs. We help you gather the supporting documents properly.
What documents are needed to sell an apartment?
The basic set includes an extract from the Księga Wieczysta, the title document (Akt Notarialny) and the Świadectwo Charakterystyki Energetycznej (the notary will not close the deal without it). To save you time in queues and offices, we prepare the entire package ourselves.
Do I need a sworn translator at the notary when selling an apartment?
If one of the parties is not fluent in legal Polish, the notary must bring in a sworn translator (Tłumacz przysięgły). This ensures the transaction is legally sound and protected. We arrange a trusted specialist in advance to avoid delays on signing day.
Where do I get the certificates to sell an apartment?
It depends on the type of ownership: the certificate of no registered residents is issued by the Urząd Dzielnicy / Miasta, the certificate of no debts by the Spółdzielnia or Wspólnota Mieszkaniowa, and mortgage statements by your bank. We prepare the right requests and collect the documents for you, turnkey.
How can I find a buyer for my apartment quickly?
The secret to a high price and a fast sale is the right pre-sale home staging, professional photography and precise targeting. We attract buyers from private investor databases and the inter-agency MLS network even before the property goes public.
All owners share one goal — to sell their apartment at the best price in the shortest time, without any legal or tax complications.

Frequently asked questions
The valuation is completely free and does not commit you to anything. Our specialist analyses the register of actual transactions in your area and prepares an objective analytical report.
Under an exclusive agreement, Mokko Real Estate covers all costs of professional photo and video shoots and advertising on Otodom, OLX, Google Ads and Meta Ads. We only take on properties we are confident we can sell, so the seller bears no financial burden for promotion.
Yes, we carry out transactions under a notarial power of attorney. We handle viewings, document preparation, legal checks and secure settlement.
Thanks to our MLS partner network (more than 2,000 agents) and a private investor database, the first qualified buyers receive the offer within 48 hours of the sales launch.
The commission is paid only after the deal has been successfully completed and the final notarial deed has been signed. The seller makes no prepayments and no marketing reimbursements.
Selling a mortgaged apartment in Poland is a standard procedure. When you work with us, Mokko's experts handle all the paperwork: we request the outstanding balance certificate (zaświadczenie o wysokości zadłużenia) and the bank details ourselves. The buyer transfers the amount owed directly to the lending bank and the rest to the seller. Once the loan is repaid, the bank issues a document to remove the encumbrance (list mazalny) from the land and mortgage register.
You cannot sell the apartment if the bank has started enforcement proceedings (egzekucja komornicza), seized the property for non-payment, or if the land and mortgage register contains court restriction notices (ostrzeżenie o wpisie). In all other cases the bank has no right to prohibit the sale.
The main downside is a slightly longer process (1–2 weeks longer) while waiting for bank certificates. With Mokko the seller feels no difficulty: we handle the communication with the bank and collect the documents ourselves.
Yes, absolutely. You can sell the apartment at any stage of repaying the mortgage. The loan is repaid by the buyer during the notarial transaction out of the purchase funds.
Settlement is made via a notary escrow account or a direct bank transfer. The purchase price is split into two parts: the first goes directly to the seller's bank to close the mortgage debt, and the remainder is transferred to the seller's personal account.
The transaction takes place at a notary in two stages: first a preliminary agreement (Umowa przedwstępna) is signed, then the bank issues a certificate with the repayment details. The final notarial deed (Umowa przeniesienia własności) sets out how the payments are made.
The main difficulty is aligning the bank's document deadlines with the notary dates so as not to exceed the bank certificate's validity (30 days). The Mokko team keeps full control of these deadlines for you.
Yes, registration (zameldowanie) does not create ownership rights. However, before the final notarial deed all residents, including minors, must be deregistered (wymeldować) and the notary must be given the relevant certificate.
If the child is only registered there, no family court (Sąd Rodzinny) approval is needed — it is enough to deregister the child before the transaction. Court approval is required only if the minor is a legal owner or co-owns a share of the apartment.
When selling property you pay personal income tax (PIT-39) at 19%. The tax applies only to the net gain (the difference between the purchase and sale price, minus renovation and transaction costs).
The rate remains 19% of the gain, but if you have owned the property for more than 5 years (counted from the end of the calendar year of purchase), the tax is 0%. You are also exempt if you spend the entire proceeds on new housing in the EU (ulga mieszkaniowa) within 3 years.
To avoid the 19% tax entirely, 5 full calendar years must pass since the purchase (counting starts on 31 December of the year in which the notarial deed was signed).
PIT-39 tax on an apartment sold in 2026 is declared and paid to the tax office (Urząd Skarbowy) between 15 February and 30 April 2027.
If less than 5 years have passed since the purchase, you will need to file a PIT-39 return. If you don't plan to reinvest the money in other housing under the ulga mieszkaniowa relief, you will have to pay 19% tax on the gain.
Do home staging, prepare professional visuals, order an energy performance certificate (Świadectwo charakterystyki energetycznej) and collect the basic certificates. At Mokko we take care of all this preparation and paperwork for you.
The key to success is a sales strategy tailored to the specific property (precise positioning, presentation, choosing the right promotion channel), plus professional home staging and maximum reach through the MLS partner network.
The main risks are a poorly drafted preliminary agreement (no deposit or vague payment deadlines), handing over the keys before receiving the full payment, and mistakes in tax planning.
Yes, a notarial power of attorney allows a representative to sign the preliminary and final agreements, obtain certificates from the relevant authorities and hand over the keys. In any case, the buyer's money is transferred only to the owner's personal bank account.
The core set includes: an extract from the land and mortgage register (Księga Wieczysta), the title document (Akt notarialny), a certificate that no one is registered at the address and a certificate of no outstanding debts. Mokko's experts collect the full set of documents for you.
You can deregister (wymeldować się) in person at the gmina/dzielnica office, online via your ePUAP profile, or by notarial power of attorney. The certificate confirming no registered residents is issued on the same day.
A cooperative ownership right is sold through a notary. You will need a certificate from the housing cooperative (Zaświadczenie ze Spółdzielni Mieszkaniowej) confirming the right and the absence of debts. We handle communication with the cooperative.
The notice period depends on the terms of your Umowa najmu (usually 1–3 months). Selling the apartment does not automatically terminate the lease — the new owner takes over the landlord's rights.
The seller pays only the agency commission after the deal is completed and small fees for certificates. The PCC tax (2%) and notary services are paid by the buyer. The seller has no marketing expenses.
The notary fee (taksa notarialna) is paid by the buyer. The only possible small cost for the seller at the notary is for certified copies of the deed (wypisy), about 6–10 PLN per page.
